1.0. Conditions of Sale
None of the conditions set out in these terms and conditions shall affect your statutory rights as a consumer. Individual goods may be the subject of additional guarantees or warranties given by their manufacturers to you. We shall not accept any liability for any ordering errors made by you when submitting your order. Please ensure that all details are correct before submitting your order. We do not accept responsibility and will not be liable for any damage to the goods caused by you. We shall not be liable to any person for any damage or loss that may arise from the use of any goods advertised on our website.
1.1. Conditions of Sale (for prescription eyewear)
You confirm that you are aged over 16 years of age and are legally able to purchase prescription spectacles from Balance Optics Ltd. You confirm that you are not registered blind or partially sighted (Severely Sight Impaired or Sight Impaired). You agree that you will provide any details reasonably requested by Balance Optics Ltd to confirm that you are legally able to purchase prescription spectacles. You agree to make purchases on the Balance Optics website using your correct name, address, date of birth and any other details requested. All prescriptions that you supply to us must have been given to you by a registered medical practitioner or registered optician following a sight test by him or her within the last two years. We can only supply prescription lenses that are available with the specific frame. The availability of the prescription available with the frame is limited to manufacturing standards, and should our suppliers decide that entered prescription is not suitable for chosen frame, then we will not be held responsible for any loss or injury occurred. When ordering from us, we shall rely upon the prescription provided by you. You are responsible for entering the prescription information and PD (pupillary distance) measurement as requested. No liability is accepted by Balance Optics for any mistake made by you in providing your prescription or PD measurement see our help section relating to entering prescription and PD measurements.
2.1. Oakley Custom Program
All Oakley Custom Products are tailor-made for you (the customer) and no one else. Because of this we cannot accept returns, exchanges or cancellations and adjustments to your order cannot be made once it has been placed we have place it with Oakley. You will have the option of receiving a final picture of your custom design for your approval after you have placed your order with Balance Optics but before the order has been placed with Oakley. This allows the customer (you) to an opportunity to change or cancel the order prior to it being placed with Oakley. If the customer decides to wave this final image email for approval, the order will be processed immediately and the above terms apply. The build process for custom products typically takes 7-10 business days while Oakley engineers custom fit and build your order to your exact specifications.
2.2. Lens Etching - Oakley Custom Policy Program
Oakley custom products are offered for personal use only, and are not to be used for any commercial gain. Oakley reserves the right to refuse any orders that contain wording or symbols which Oakley believes in its sole discretion to be inappropriate, infringing of other’s rights or disparaging to the Oakley brand in any way. By ordering a custom Oakley product, the consumer agrees to take full responsibility and to indemnify Oakley for any clains made by a third party that any part of the personalization created by the consumer infringes the rights of or otherwise damages the third party.
3.0. Availability of goods
All goods advertised on the site are subject to availability. Generally we aim to make sure you receive the goods within 48 hours of ordering, however, if the item is out of stock, we will give you an estimated delivery time. If an item that you wish to order is unavailable, we shall inform you by e-mail. You will not be charged for any goods that we cannot supply, however, we will not be responsible for any losses or damage that may occur if we fail to supply goods. We have made every effort to display all the goods on the website as accurately and fairly as possible, though some variation may exist and pictures are for illustrative purposes only. We will meet our responsibilities under this contract within a reasonable time unless it is impossible to do so because of circumstances beyond our reasonable control; in particular we will not be responsible for delays caused by our suppliers.

3.2. 24 hour deliveryWe offer 24hour delivery on a number of items. If the item is out of stock due to high levels of demand, we will still aim to get the product to you within 48 hours, and if longer, we will notify you.
All pictures of goods are for illustrative purposes only. The pictures shown of the goods are supplied by the manufacturers. Some variation in colour may exist- and lens tints may vary. Prescription lenses will be thicker than those illustrated, owing to the nature of the lens. Shield sunglasses, such as Oakley Radar Path have the prescription lens glazed within the shield, and will therefore have an obvious join.
The prices displayed on our website are correct at the time of display. We reserve the right to alter prices without notice, though once your order has been accepted, we will not change the price that applies to that order. For prescription eyewear, all prices shown are fully inclusive of two prescription lenses (or 1 in the case of those glazed within the shield), optical adaptors (if required) and glazing.
5.0. Payment information
We accept payment by credit/debit card (Visa/Mastercard), by Paypal account and Google account checkouts. Goods will usually only be delivered to the registered address of the credit card used for payment. All credit and charge card payments are subject to validation and authorization by the card issuer. If your card issuer refuses to authorize payment, we will not be liable for any non-delivery or delay. Goods remain the property of Balance Optics Ltd until paid for in full. All payment must be made in full before goods are dispatched. You will receive written confirmation of your order by email to signify the contract has been concluded and payment confirmation. By placing an order you agree to receive e-mails from us regarding special offers and other information relevant to your purchase. You can choose not to receive e-mails from us at any time by notifying us at email@example.com.
5.1. Delivery of goods
Delivery will be by Royal Mail First Class Recorded Delivery. We find this the most convenient method, and if no-one is present to receive the goods, they will be held at your local sorting office for collection.
We also offer more speedy delivery. We will endevour to dispatch goods on the next working day. There may be delays due to adverse weather etc. The charge for this service is £6.
We aim for you to receive your goods within 48 hours of ordering, however, if there is going to be a delay, we shall inform you of this. There is no charge for delivery within the UK, however, outside of the UK will incur a delivery charge. For prescription orders, delivery is almost always within 1-2 weeks. For directly glazed sunglasses, such as those by Oakley or Bolle, it is closer to 2 weeks. For ski goggles and sunglasses that work with prescription inserts, delivery is usually within one week. All items will be delivered to the address specified by the customer on the order form.
Any delivery date given or implied is an estimate only, we cannot guarantee that goods will be delivered by the estimated delivery date. You agree that we shall not be liable to you for any losses, damages or charges incurred by you because of the late delivery of goods. You agree to inspect the goods upon delivery and to notify us immediately by sending an email to firstname.lastname@example.org should they be in any way defective or inconsistent with your order. In any such event you must not use the product.
Each of the items delivered will include written confirmation of the description of the goods. This will match the original confirmation of the order. If you have ordered prescription eyewear, the prescription shall also be stated. If the prescription stated does not match the prescription ordered, please contact us to inform us of the problem and do not use the goods. When you have received the goods at the specified address, the risk of damage to the goods is passed to you.
Please note that the customer bears full responsiblity for correctly entering their delivery address. Balance Optics cannot be held liable for goods sent to incorrect adresses the customer enters. We will do our best to track and have the goods returned to us if this occurs.
All orders that have been returned to us by Royal Mail due to the address being incorrect, or that the item was not collected from their sorting office will have to pay for redelivery. We offer free postage initially, but cannot offer free postage if the above occurs. Standard Recorded delivery is charged at £3.
6.0. Returning goods
It is our aim to ensure that you are completely satisfied with the goods that you receive from us. Under the Customer Protection (Distance Selling) Regulations 2000 customers have a 7 working day cooling off period. However, we double this, and give a full 14 days from the date of receiving the goods. Therefore, for whatever reason, if you are not completely satisfied with the goods that you have purchased you have the right to a full refund, alteration or replacement. (If there is a difference in the price of the goods, this cost shall have to be met by yourself). This cancellation right starts the day the contract is concluded and lasts until 14 days after delivery. (This government regulation excludes goods made to customers specifications or goods that are personalized, such as prescription orders). Should it be necessary to return the goods you are liable for their safe-keeping until such time as they are delivered to us including any period in transit. If the goods are faulty or incorrect, we shall meet the cost of delivery back to ourselves, however, in all other cases, return costs (which must be by Royal Mail Signed For Delivery) shall be met by yourself.
If you need to return the goods for any reason, you must first obtain a returns number by emailing email@example.com. The risk of damage to any goods returned to us will remain with you until they have been delivered and accepted by us at our premises.
Balance Optics Ltd will not be liable for any visual problems, loss of any nature, accident or injury, as a result of incorrect information supplied by you or the original prescriber. Balance Optics Ltd does not accept liability for any consequential or incidental damages as a result of products purchased from or use of this website and our liability for direct loss is limited to the purchase price of the product from which any such claim shall arise. Balance Optics Ltd shall not be liable for any allergic reaction to frame or lens materials. All frame materials are indicated in the frame description/specifications and the purchaser accepts full responsibility for choosing a frame based on this information. Frames described as ‘Metal’ may contain nickel alloys and frames are not supplied as ‘non-allergenic’.
We offer a 14 day money back guarantee for non personalised (prescription or custom) eyewear, provided that the goods are returned in unused, original condition.See the returns section above for more details. You must obtain a returns number by sending an email to firstname.lastname@example.org before claiming under this guarantee. All spectacles carry a 12 month guarantee against faulty materials and defective workmanship. To claim under this guarantee you must obtain a returns number by sending an email to email@example.com. Refunds will not be made for return postage. We reserve the right to repair or replace faulty goods at our discretion. Guarantees will not apply where goods have been subject to misuse, have not been used for the intended purpose or have not been used or cared for in accordance with any specific instructions issued with the product. Refunds will not be made if incorrect prescription information has been entered by the customer at the time of order.
9.0. Gift Vouchers
Gift vouchers must be bought from www.balanceoptics.com. No other gift vouchers are applicable. A unique code will be provided with the gift voucher, which will be input into the discount code area at our checkout. The reciptitant of the voucher can choose any product of their choice from our site, and use the voucher toward payment. Should the product chosen be of a lesser value than the voucher value, we will not be able to offer cash difference.
We reserve the right to amend prices and specifications without notice. These terms and conditions shall be governed by English Law. Discount codes are valid for a maximum of six months from issue date or publication date (unless otherwise stated on the code). We can only supply lenses to a valid prescription that is less than two years old and we reserve the right to ask for a copy of that prescription. We cannot supply lenses to those who are under 16 or registered partially sighted. A binding contract is only entered into when we accept your order. Nothing in these terms and conditions shall effect your statutory rights.
